United States – 2024 OSHA’s Hazard Communication Standard (HCS) Update
Updated Standard Effective July 19, 2024
The Occupational Safety and Health Administration (OSHA) issued a final rule on May 20, 2024, updating its Hazard Communication Standard (HCS) to mainly align with the 7th revision of the UN’s Globally Harmonized System (GHS), incorporating select elements from the 8th edition.
Significant Changes Include:

Revised hazard classifications—such as desensitized explosives, chemicals under pressure, and refined criteria for flammable gases, aerosols, etc.

Enhanced SDS—and labeling—content:

Section 1 must now include a designated U.S. “responsible party”, improving accountability

Section 3 (composition) now requires prescribed concentration ranges, balancing transparency with protection of proprietary data

Section 9 must feature expanded physical and chemical property data

New nuances like small container labeling exemptions, detailing chemical reaction hazards in Section 2, revised Section 7 (storage provisions), and updated Section 9 inclusion lists

Compliance Deadlines:

Substances: SDS and labels must comply by January 19, 2026.

Mixtures: Full compliance by July 19, 2027
Ongoing Obligations:

SDSs must be updated within 90 days of discovery of new hazard data

Employers must maintain accurate chemical inventories, update training accordingly, and keep SDSs accessible, including via digital tools like QR codes
Canada – WHMIS 2022 (Amendments to HPR)
Amendment In Force Since December 15, 2022; Transition Ends December 14, 2025
Canada updated its Hazardous Products Regulations (HPR) as of December 15, 2022, to align with GHS 7th revision (and select aspects of the 8th). The three-year transition period concludes on December 14, 2025.
Key Regulatory Updates:

Introduction of new hazard classes/categories, including chemicals under pressure and non-flammable aerosols, plus modified flammable gas subcategories

Expanded SDS content, particularly in Sections 9 (physical/chemical properties) and Section 14 (transport classification)

Refined classification thresholds and definitions to reflect updated hazard science
Transition Guidance:

During the transition, entities must choose to fully comply with either the old or updated HPR—not a mix of both

Provinces like Ontario have already begun inspection blitzes to ensure updated WHMIS training reflects new regulatory changes
SDS Update & Language Requirements:

SDSs must provide accurate hazard information, updated when significant new data arises

While the three-year mandatory update cycle was removed federally, many provinces still require employers to update or confirm SDSs every three years or within 90 days of new data
-
SDSs must be bilingual (English and French) — either combined or provided as distinct documents simultaneously
